General Terms and Conditions for the Provision of Services by grind & glow, Performance & Nutrition Coaching, Bundesplatz 12, 10715 Berlin, Email: mona@grind-glow.com
(hereinafter referred to as the “Contractor”) towards its clients (hereinafter referred to as the “Client”)

1. General Provisions

1.1 These General Terms and Conditions (GTC) apply to contracts concluded between the Client and the Contractor that incorporate these GTC.

1.2 If additional contractual documents or other terms and conditions have become part of the contract in written or text form alongside these GTC, their provisions shall take precedence in the event of any contradictions.

1.3 Any terms and conditions deviating from these GTC and used by the Client shall not be recognized by the Contractor unless expressly agreed otherwise.


2. Subject Matter and Scope of Services

2.1 The Contractor, acting as an independent entrepreneur, provides the following services to the Client:

The Contractor offers personalized 1:1 online coaching in the areas of training and nutrition, specifically for CrossFit and functional fitness athletes. In addition, in-person personal training is offered in Berlin. Online coaching is conducted via the training platform TrueCoach, through which the Client receives customized training plans, nutrition plans, and feedback. The Terms of Use and Privacy Policy of TrueCoach also apply, as personal data is processed through their platform.

The coaching programs are structured as follows:

a. Essential Coaching: Ideal for individuals seeking to improve strength, conditioning, and functional fitness. Includes an introductory consultation, individual assessment, weekly training plans (up to 3 sessions/week), feedback and support via app.

b. Performance Coaching: Designed for experienced athletes focusing on ambitious, goal-oriented training. Includes all services of Essential Coaching, but with 5+ training sessions per week.

c. Nutrition Coaching: For clients with specific nutrition goals (e.g. muscle gain, fat loss, performance optimization). Includes assessment, nutrition plan, tracking, bi-weekly check-in calls, and app-based communication.

d. Complete Coaching: A combination of Performance and Nutrition Coaching, including all of the above-mentioned training and nutrition services.

e. Personal Training (in-person in Berlin): One-on-one support focusing on technique, strength, mobility, and individual goals. Sessions are 60 minutes in length.

2.2 The specific scope of services is subject to individual agreements between the Contractor and the Client.

2.3 The Contractor shall perform the contracted services with the highest possible care and diligence, based on the latest standards, rules, and knowledge.

2.4 The Contractor is obliged to provide the agreed services but is not subject to any instructions regarding how, where, or when the services are rendered. The Contractor independently determines the schedule to ensure optimal efficiency and the fulfillment of the contract's purpose. Services are delivered in coordination with the Client.

3. Client’s Obligations to Cooperate

The Client is responsible for providing all necessary information, data, and other content accurately and completely for the fulfillment of services. The Contractor is not liable for delays or service disruptions caused by the Client’s failure to cooperate; this does not affect the provisions under "Liability/Indemnity."

The Client agrees to:

Provide accurate and complete information necessary for coaching, including medical conditions or pre-existing health issues.

  • Give honest feedback on the implementation of training and nutrition recommendations.

  • Be punctual for scheduled (online) appointments.

  • Use the designated communication channels (e.g., no coaching via Instagram DMs).

  • Delays caused by insufficient cooperation are not the responsibility of the Contractor.

4. Fees and Payment Terms

4.1 The remuneration is based on the selected package and must be paid before the start of the service. Payments are made via the contractor’s online shop on their website using PayPal or Stripe. The terms of service and privacy policies of these providers apply:

  • Monthly payments

  • 3-month prepayment with a 10% discount

  • 6-month prepayment including 1 month free

4.3 Monthly payments are billed in advance on a monthly basis.

4.4 Invoices are sent via email (e.g., as PDF).


4a. Cancellation and Missed Appointments

Scheduled appointments (e.g., personal training or 1:1 calls) can be rescheduled free of charge up to 24 hours in advance. In case of late cancellation or no-show without valid reason, the session will be considered as completed.

Exceptions due to illness or force majeure may be accommodated after individual discussion.


5. Liability / Indemnity

5.1 The Contractor is fully liable in cases of intent or gross negligence, or for damages resulting from injury to life, body, or health caused intentionally or negligently, or based on a warranty, unless stated otherwise, or where mandatory liability applies. For breaches of essential contractual obligations due to slight negligence, liability is limited to typical, foreseeable damages. Essential obligations are those which are necessary for achieving the purpose of the contract. Otherwise, any liability is excluded. These limitations also apply to legal representatives and vicarious agents of the Contractor.

5.2 The Client indemnifies the Contractor against any third-party claims arising from violations of these contractual conditions or applicable law.

5.3 The training and nutrition advice provided does not replace medical, therapeutic, or psychological treatment. By entering into the contract, the Client confirms they have no health concerns preventing participation. Implementation is at the Client’s own responsibility.

6. Contract Duration and Termination

6.1 The duration and termination notice periods are agreed individually between the parties.

6.2 The right of both parties to terminate without notice for good cause remains unaffected.

6.3 Upon termination, the Contractor shall return or destroy any provided documents or content at the Client’s discretion without delay. Retention rights are excluded. Electronic data must be fully deleted, except where longer statutory retention periods apply. The Contractor shall confirm deletion in writing upon request.

7. Confidentiality and Data Protection

7.1 The Contractor shall treat all information obtained in connection with the assignment as strictly confidential. This confidentiality obligation extends to any employees and/or third parties with access to such information. The obligation remains in effect indefinitely beyond the term of the contract.

7.2 The Contractor undertakes to comply with all applicable data protection laws, particularly the GDPR and the German Federal Data Protection Act, when executing the contract.

7.3 Third-party providers are used as part of the coaching services, in particular:

The processing of personal data by these providers is carried out under their own responsibility.

8. Final Provisions

8.1 The laws of the Federal Republic of Germany shall apply, excluding the CISG.

8.2 Should any provision of these GTC be or become invalid, the remaining provisions shall remain unaffected.

8.3 The Client agrees to cooperate as necessary for the provision of services. This includes providing the Contractor with all necessary information and data.

8.4 If the Client is a merchant, legal entity under public law, or has no general place of jurisdiction in Germany, the parties agree that the Contractor’s registered office shall be the exclusive place of jurisdiction. Mandatory exclusive places of jurisdiction remain unaffected.

8.5 The Contractor may amend these GTC for legitimate reasons (e.g., changes in law, jurisdiction, market conditions, or business strategy) with reasonable notice. Existing clients will be informed at least two weeks before the changes take effect via email. If the client does not object within the specified period, their consent is deemed given. If the client objects, the changes will not take effect, and the Contractor may terminate the contract exceptionally at the time the changes would have come into effect. The notice will include information about the objection period and consequences.

9. Information on Online Dispute Resolution / Consumer Arbitration

The EU Commission provides an online dispute resolution platform at:

This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.
The Contractor is neither willing nor obliged to participate in consumer arbitration proceedings under the German Consumer Dispute Resolution Act (VSBG).
